Habitum Terms of Use
The agreement covering your use of Habitum, including how the Plus upgrade is billed and cancelled.

1.Agreeing to these terms
These terms are between you and Mishael Oblefias, the developer of Habitum. Downloading or using Habitum means you accept them. If you do not, please do not use the app.
Your purchase also sits under Apple's Licensed Application End User License Agreement, which applies to every app bought from the App Store. Where these terms and Apple's disagree, Apple's standard EULA governs.
2.What you may do with the app
You get a personal, non-exclusive, non-transferable licence to use Habitum on Apple devices you own or control, as permitted by the App Store terms and Apple's usage rules.
You may not sell, rent, sublicense or redistribute the app, and you may not reverse-engineer, decompile or attempt to derive its source code, except where law expressly permits it regardless of this restriction.
3.Your content is yours
Everything you put into Habitum belongs to you. We claim no ownership of it and no licence over it — which is straightforward for us to promise, since it never reaches us. Keeping your own backups, whether through iCloud or the app's export, is your responsibility.
4.Subscriptions and purchases
Habitum is free to download, with some features unlocked by a paid upgrade. The upgrade is sold as a monthly subscription, a yearly subscription, or a one-time lifetime purchase. Current prices are shown in the app before you buy, in your local currency.
- Payment is charged to your Apple Account at confirmation of purchase.
- A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the period ends, at the price then in effect.
- You can manage or cancel a subscription in Settings → your name → Subscriptions on your device. Deleting the app does not cancel it.
- A lifetime purchase is a one-time payment for the current version of the app and its ongoing updates, for as long as the app is offered. It does not renew.
- Any unused part of a free trial is forfeited if you buy a subscription during it.
5.Refunds
Apple sells Habitum and handles all payments, so Apple also handles refunds. Request one at reportaproblem.apple.com. We cannot issue refunds ourselves, though we are glad to help you sort out a problem — write to support@vitum.app first and we will try to fix whatever went wrong.
Nothing here limits any statutory right to a refund that the law of your country gives you.
6.Not medical advice
Habitum is a tracking tool for your own use. It is not a medical device, and nothing in it is medical advice, diagnosis, or treatment.
Figures it shows — including anything read from Apple Health — are there to help you notice patterns, not to make clinical decisions. Do not use it to diagnose or treat a condition, and never disregard or delay professional medical advice because of something you saw in the app. If you think you may have a medical emergency, contact a doctor or your local emergency number.
Decisions about your health, your training, or your medication are between you and a qualified professional.
7.Fair use of the app
Do not use Habitum unlawfully, do not try to break or circumvent its purchase checks, and do not interfere with its operation for anyone else. If you share progress with another person, do so only with their agreement.
8.Availability and changes
We may add, change or remove features as Habitum develops, and a future version may require a newer version of iOS. We may also stop offering the app; if that happens, the copy you have installed keeps working for as long as your devices support it, and we will give reasonable notice through the app or this site where we can.
9.Warranties
Habitum is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will preserve your data without loss.
Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you. Where the law gives you guarantees that cannot be excluded, those guarantees stand.
10.Limits on liability
To the fullest extent permitted by law, Mishael Oblefias is not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Habitum.
Where liability cannot be excluded, it is limited to the amount you actually paid for the app in the twelve months before the claim arose.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not permit to be excluded.
11.Apple's position
Apple is not a party to these terms and has no responsibility for Habitum. Apple has no obligation to provide support for it. Apple is, however, a third-party beneficiary of these terms and may enforce them against you.
Any claim that Habitum fails to conform to a warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation for the app. Claims relating to the app — including product liability, legal non-conformity, and consumer-protection claims — are our responsibility and not Apple's.
12.Governing law
These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules, and the courts of the Philippines have jurisdiction over any dispute arising from them.
If you use Habitum as a consumer elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions in your own country of residence.
13.Changes to these terms
We may update these terms as Habitum changes. The date at the top shows when they were last revised, and continuing to use the app after a revision means you accept it. If a change is significant, we will say so in the app's release notes.
